General Terms and Conditions of Sale – Version January 1, 2025


Article 1: Scope

These General Terms and Conditions of Sale (GTC) govern sales made on the website PROVENCE D’ANTAN, URL: provence-dantan.fr, operated by ARAQUELLE SAS. They apply to the exclusion of any other conditions, including those applicable to in-store sales or through other distribution channels.

Article 3: Products

Products are presented with their essential characteristics in the online product descriptions.

Product images are for illustrative purposes and do not constitute a contractual commitment.

Promotions and availability are valid as long as they appear on the site and stocks last. If a product is unavailable after an order is placed, the customer will be refunded and notified by email.

Article 4: Orders

The customer must create an account on the site with accurate and complete information. Orders are placed exclusively through the website. Any order implies acceptance of these GTC. An order confirmation will be sent by email to the buyer.

ARAQUELLE SAS reserves the right to refuse an order for any legitimate reason (payment issues, insufficient stock, etc.).

Article 5: Prices and Payment

Product prices are stated in euros, including all taxes (VAT included), excluding delivery fees. Delivery fees are displayed before order confirmation.

Payment is made at the time of the order through the secure payment methods offered on the site. Order registration and processing are subject to payment validation.

Article 6: Delivery

Products are delivered to the address provided by the buyer during the order process. Delivery times are indicative.

ARAQUELLE SAS cannot be held liable for delivery delays caused by the carrier or external circumstances. Delivery fees, calculated before order confirmation, are clearly displayed in the summary.

Article 7: Right of Withdrawal and Returns

In accordance with Article L.221-18 of the French Consumer Code, buyers have a 14-day withdrawal period. Returns must be made in their original packaging, accompanied by the invoice. Return costs are borne by the buyer, except in the case of an error on our part.

Article 8: Warranties

Products are covered by the legal warranty of conformity and the warranty against hidden defects, in accordance with Articles 1641 and following of the French Civil Code.

Article 9: Data Protection

Data collected is essential for order processing and customer relationship management. It is handled in compliance with applicable regulations, particularly GDPR.

Customers have the right to access, correct, and delete their data by contacting Araquelle via email or postal mail.

Article 10: Complaints and Mediation

For any complaints, buyers may contact customer service at info@provence-dantan.fr. In accordance with Article L.616-1 of the French Consumer Code, buyers may also refer to a consumer mediator.

Article 11: Applicable Law and Jurisdiction

These GTC are governed by French law. In case of disputes and in the absence of an amicable resolution, the competent court will be the one where the seller resides.

Article 12: Modification of the GTC

ARAQUELLE SAS reserves the right to modify these GTC at any time. The applicable GTC are those in force on the date of the order.

Article 13: Cookies

Cookies may be installed on the customer’s device to improve navigation and personalize the services offered.

Article 14: Intellectual Property

All content (texts, images, graphics) on the site is the exclusive property of ARAQUELLE SAS. Any reproduction, even partial, without prior authorization is strictly prohibited.

Article 15: Archiving and Proof

ARAQUELLE SAS will archive order forms and invoices on a reliable and durable medium, constituting a faithful copy in accordance with Article 1348 of the French Civil Code.

The computerized records of ARAQUELLE will be considered as proof of communications, orders, payments, and transactions between the parties.
